Se ha señalado con frecuencia el escaso tratamiento de Heidegger acerca del amor. Se busca recuperar y articular algunas alusiones importantes. Cabe distinguir tres registros temáticos: como modo de “encontrarse”, como “actitud” con los otros y como rasgo del “ser mismo”. Se intenta no solo comprender el fenómeno amoroso en el pensamiento heideggeriano, sino mostrar la incidencia que habría tenido en la interpretación de otras cuestiones y, sobre todo, en el asunto central sobre el sen-tido del Ser.

It has often been argued that Thomas More’s Utopia is fundamentally concerned with outlining and theoretically justifying an ideal model of society and not with determining what would be the practical steps required for its establishment in the real world. Even if we were to accept this widespread interpretation, I consider that it is possible to recognize in the text indications that suggest two different and even opposing paths along which the political construction of Utopia could take place. The first, (...) and strictly speaking, the only one that the work is trying to put forward, is individual, elitist, coercive, and top-down. The second that, for its part, seems to be presented rather with the intention of preventing it from coming to fruition is hence, on the contrary, collective, popular, insurrectionary and from below. The present article tries, first, to show how and through what arguments these two models of action are presented in More’s work, taking note, in addition, of the important difficulties involved in the one which it intends to propose. After this, two historical realizations immediately after Utopia was published that illustrate them are developed. Finally, the present article tries to establish what relationship these two paths have with each other according to the work’s approach and, also, suggest what alternative relationship they could maintain if a different point of view was attempted. A los efectos de mostrar el compromiso de Utopía de Moro con el ideal republicano de una civitas libera se siguen en este trabajo tres pasos o momentos. Tras unas breves, pero necesarias consideraciones terminológicas acerca de los dos principales sentidos de “república” a comienzos del siglo XVI, se desarrolla la concepción acerca de la naturaleza y legitimidad del poder defendida en la obra. Luego se analiza cómo dicho principio se traduce en las instituciones y prácticas de la comunidad utopiense. (...) Y finalmente se intenta dar cuenta de cómo dichas instituciones y prácticas cristalizan en aquel modelo político (típico del republicanismo renacentista) llamado “régimen mixto”, que combina la monarquía, la democracia y la aristocracia. Ahora bien, la expresión concreta de este último aspecto en la vida de Utopía da lugar a una interesante tensión interna. En efecto, por una parte, produce una significativa restricción de la libertad política al reconocer derechos desiguales al “pueblo” (que solo elige, pero no puede ser elegido para las principales magistraturas) respecto del estamento intelectual (que es el único que puede ser elegido para las mismas). Pero, al mismo tiempo, si tenemos en cuenta que la pertenencia a dicho estamento no depende en absoluto de la riqueza (puesto que en Utopía no hay propiedad privada, sino propiedad común), de aquí podemos inferir que se ha comenzado a pensar de modo decidido y disruptivo la igualdad material como condición necesaria de la auténtica libertad política. The progressive publication -along the past two decades- of the courses taught by Heidegger in his first years in teaching has allowed the reconstruction of the process of creation of Being and Time , its multiple textual references and influences. Among these, St. Augustine's thought bears a prominent place, for which reason I intend to consider its noticeable presence in some of the key concepts in the work mentioned. The first to be considered is Sorge , with which Heidegger characterises (...) the fundamental ontological constitution of human existence. His first drafts emerged from the reflection upon the famous "inquietum cor nostrum" and the cura for the vita beata from Confessions X. Based on this same text Heidegger had offered a phenomenological interpretation of temptation, which constitutes one of the first elaborations of the so-called "fall", precisely one of the structural moments of the Sorge. Explicit references or suggestive analogies between both thinkers can also be appreciated between the explanation of "tempus" as "distentio animi" in Confessions XI and the heideggerian thesis of "temporality" as the basis of the constitution of human subjectivity; the road from the search of God to the exploration of the interiority of the one who looks for Him and the way back from the question about the "being" to the question about the one who understands the "being", in other no less significant cases.La progresiva publicación a lo largo de las últimas dos décadas de los cursos dictados por Heidegger durante sus primeros años de docencia ha permitido reconstruir el proceso de gestación de Ser y Tiempo , sus múltiples referencias textuales e influencias. Entre ellas, ocupa un lugar destacado el pensamiento agustiniano, por lo cual me propongo considerar aquí su fuerte presencia en algunos de los conceptos centrales de dicha obra. El primero a tener en cuenta es el de "Sorge" con el que Heidegger caracteriza la constitución ontológica fundamental del existir humano. Sus primeros esbozos habían surgido de la reflexión en torno al célebre "inquietum cor nostrum" y a la cura por la vita beata de Confesiones X. A partir de este mismo texto Heidegger había realizado también una interpretación fenomenológica de la tentación, que constituye una de las primeras elaboraciones de la llamada "caída", precisamente uno de los momentos estructurales de la "Sorge". Referencias explícitas o sugerentes analogías entre ambos pensadores pueden apreciarse también entre la explicación de Confesiones XI del "tempus" como "distentio animi" y la tesis heideggeriana de la "temporalidad" como fundamento de la constitución de la subjetividad humana; el tránsito desde la búsqueda de Dios a la exploración de la interioridad de aquel que lo busca y el retroceso desde la pregunta por el "ser" a la pregunta por el que comprende el "ser", entre otros casos no menos significativos. At the beginning of the 20th century Machiavelli is an author celebrated by Ortega y Gasset: the philosopher of Madrid despises the nineteenth century, epilogue of an era, as much as he admires the Renaissance. Twenty years later - in España invertebrada - Ortega reads the pages of Il Principe as the brilliant commentary “from an Italian to the deeds of two Spaniards”, Fernando el Católico and César Borja. D ‘Ors’s position is very different. Although in 1920, in favor of (...) Machiavelli, he opposed “vulgar beliefs”, certainly ends up among the most radical critics. According to d ‘Ors, Machiavelli reaffirms in modernity the paganism of the Emperor Julian and anticipates - against Dante and his theory of the empire - the fate of a fragmented Europe, in which ideas and nations fight, without any reference to a universal authority. In this work I argue that Descartes was not a trialist by showing that the main tenets of trialist interpretations of Descartes's theory of substance are either not supported by the text or are not sufficient for establishing the trialist interpretation.

Dante's Convivio, composed in exile between 1304 and 1307, is a series of self-commentaries on three of Dante's long poems. These allegorical love poems and philosophical verse become the basis for philosophical, literary, moral, and political exposition. The prose is written in Italian so that those who were not educated in Latin could take part in what Dante called his 'banquet of knowledge'. In this edition, eminent Dante translator-scholar Andrew Frisardi offers the first fully annotated translation (...) of the work into English, with an extensive introduction, making Dante's often complex writings accessible to scholars and students. The parallel Italian text is also included for the first time in an English translation of the Convivio. Readers of this work can gain a strong understanding of the philosophical themes across Dante's work, including the Divine Comedy, as well as the logic, politics and science of his time. (shrink)

Eugenio Bulygin is a distinguished representative of legal science and legal philosophy as they are known on the European continent - no accident, given the role of the civil law tradition in his home country, Argentina. Over the past half-century, Bulygin has engaged virtually all major legal philosophers in the English-speaking countries, including H.L.A. Hart, Ronald Dworkin, and Joseph Raz. Bulygin's essays, several written together with his eminent colleague and close friend Carlos E. Alchourrón, reflect the genre familiar from (...) Alf Ross's On Law and Justice, Hans Kelsen's Pure Theory of Law, and Georg Henrik von Wright's Norm and Action. Bulygin's wide-ranging interests include most of the topics found under the rubric of analytical jurisprudence - interpretation and judicial reasoning, validity and efficacy of law, legal positivism and the problem of normativity, completeness and consistency of the legal system, the nature of legal norms, and the role of deontic logic in the law. The reader will take delight in the often agreeably unorthodox character of Bulygin's views and in his hard-hitting arguments in defence of them. He challenges the received opinion on gaps in the law, on legal efficacy, on permissory norms, and on the criteria for legal validity. Bulygin's essays have been wellnigh inaccessible in the past, appearing in specialized journals, often in Spanish or German. Migrant farmworkers dominate the horticultural workforce in many parts of the Minority (developed) World. The ‘manual’ work that they do—picking and packing fruits and vegetables, and pruning vines and trees—is widely designated unskilled. In policy, media, academic, activist and everyday discourses, hired farm work is framed as something anybody can do. We interrogate this notion with empirical evidence from the Sunraysia horticultural region of Australia. The region’s grape and almond farms depend heavily on migrant workers. By-and-large, the farmers and farmworkers (...) we spoke to pushed back against the unskilled tag. They asserted that farmworkers acquire knowledge and skills over time and that experienced farmworkers are valuable—their value being brought into sharp relief against accounts of inexperienced farmworkers’ errors. Our interviewees provided rich insights into farmworkers’ engagements with crops and the intricacies of picking and pruning well. Far from being bereft of knowledge and skills, they recognised that experienced farmworkers bring benefits. They improve productivity, product quality and ultimately profits. This is especially so when open communication channels exist across the farm hierarchy, when experienced farmworkers’ insights are taken seriously by their employers. Our research is informed by organisational studies literature and scholarship on craft/making. Like factory floor workers and artisans, experienced farmworkers bring accumulated knowledge and skills to their work, gained through repeat performance. They reflect on and adjust their activities in dialogue with their materials and the environment. Experienced farmworkers demonstrate care, dexterity and judgement. They are not unskilled, and they are more than labouring bodies. (shrink)

Originating from a little network of philosophers based in Oxford, Cambridge, and Vienna, analytic philosophy has become during the Twentieth century a thriving philosophical community with thousands of members worldwide. Leveraging the most advanced techniques from bibliometrics, citations and acknowledgments are used in this book to shed light on both the epistemology and the sociology of (...) this philosophical field, illuminating the intellectual trajectory of analytic philosophy as well as the social characteristics of the analytic community. Conventional quantitative methods for the measurement of organizational legitimacy consider mainly three sources that make judgments about organizations visible: news media, accreditation bodies, and surveys. Over the last decade, however, social media have enabled ordinary citizens to bypass the gatekeeping function of these institutional evaluators and autonomously make individual judgments public. This inclusion of voices beyond functional and formally organized stakeholder groups potentially pluralizes the ongoing discussions about organizations. The individual judgments in blogs, tweets, and Facebook posts give indication about (...) the broader fit between an organization’s perceived behavior and heterogeneous social norms and therefore constitute an indicator of organizational legitimacy that can be accessed and measured. We propose the use of social media data and sentiment analysis to study the affect-based responses to organizational actions by citizens. We critically discuss and compare the method with existing quantitative methods for legitimacy measurement and apply them to a recent case in the banking industry. We discuss the value of the method for studying the process of legitimacy construction as the expression and negotiation of normative judgments about organizations by various evaluators. (shrink)

_Abstract_: Fueled by the rapid development of neuroscientific tools and techniques, some scholars consider the shift from traditional cognitive psychology toward cognitive neuroscience to be a _revolution_ (most notably Boone and Piccinini). However, the term “revolution” in philosophy of science can easily be construed as involving a paradigm shift in the sense of Kuhn’s _The Structure of Scientific Revolutions_. Is a Kuhnian account sound in the case at hand? To answer this question, we consider heuristic indicators of two features of (...) paradigm shifts: the incommensurability of ontologies; and a gap between scientific communities. Standard citation-based bibliometric tools have severe limitations when they are applied to periods in the history of science and the humanities before the advent of now-current citation practices. This paper presents an alternative method involving the extracting and analysis of mentions to map and analyze links between scholars and texts in periods that fall outside the scope of citation-based studies. Focusing on one specific discipline in one particular period and language area—Anglophone philosophy between 1890 and 1979—we describe a procedure to (...) create a mention index by identifying, extracting, and disambiguating mentions in academic publications. Our mention index includes 1,095,765 mention links, extracted from 22,977 articles published in 12 journals. We successfully link 93% of these mentions to specific philosophers, with an estimated precision of 82% to 91%. Moreover, we integrate the mention index into a database named EDHIPHY, which includes data and metadata from multiple sources and enables multidimensional mention analyses. In the final part of the paper, we present four case studies conducted by domain experts, demonstrating the use and the potential of both EDHIPHY and mention analyses more generally. (shrink)

The article examines one quodlibet of thomas of sutton (c. 1287 a. d.) and compares it with a quodlibet of william of ockham (d. 1349 a. d.). both attack the position of henry of ghent on the distinction between essence and existence. and both reach opposite conclusions. thomas of sutton argued that the distinction is a real one, while ockham saw it only as nominal and connotative. the opposing views stem from different epistemologies and different metaphysics.

In this article, I report on a Bulgarian female migrant caregiver's “life-story,” especially focusing on her relationship with an old Italian woman, on the care practices performed in her favor in Italy, and on her daughter and parents still living in Bulgaria. I chose to do it by means of an anthropological approach based on experience as field of mediation between personal dimensions and historical and social processes and therefore centered on the body conceived as historical product, the influence of (...) political and social forces on shaping human lives, and finally interest in the specific link between bodies and work. From this analysis, based on language and narratives, I think useful cultural aspects may emerge about “gender” and care practices, regarding the two women linked by an assistance relationship, and the activities/strategies used by the Bulgarian caregiver to fulfill her family obligations. Psychopathy is typically seen as a trait that is undesirable in any context, including the workplace. But several authors have suggested that people high in psychopathy might possess resources that preserve their ability to perform well in stressful contexts. We consider the possibility that primary psychopathy is adaptive—for the employee, if not for the organization—under conditions of abusive supervision. In particular, we draw from the multimotive model of interpersonal threat and the theory of purposeful work behavior to argue that high (...) primary psychopathy individuals possess characteristics that enable them to experience higher levels of well-being and lower levels of anger than their peers under abusive supervisors. Based on a scenario study and a time-lagged field study, we found support for a model in which abusive supervision moderates the relationships between primary psychopathy and positive work-related outcomes, such that these relationships are positive under conditions of abusive supervision and either diminished or negative under conditions of low abusive supervision. Abusive supervision also affected the relationship between primary psychopathy and anger in the field study such that high primary psychopathy individuals were less angry under more abusive supervisors. Thus, there appears to be some credence to the notion of a “psychopathic advantage” in that primary psychopaths do have access to greater psychological resources than their peers under abusive supervision. However, these findings also suggest that abusive supervisors may empower employees with characteristics that hold strong potential to damage the organization and its stakeholders. (shrink)

This article moves from the observation that one of the key characteristics of contemporary Italian fiction is a preoccupation with ethics and more specifically with the issues raised by the “ethical turn” in contemporary philosophy and theory. Current literary criticism, it is argued, has been slow to respond to the ethical dimension of these narratives whose innovative and important cultural contribution has yet to be fully appreciated. It is therefore necessary to develop a keener sensitivity to the ethical discourses developed (...) in these literary texts, but this can only be achieved by first confronting some fundamental questions about the relationship between ethics and literature today. The answers to these questions make it possible to elaborate an initial conceptual framework that can re-orient reading and enable the critic to respond adequately to the ethical issues raised in and by the narrative. Accordingly, in this article the author proposes to explore from a theoretical perspective the relationship between ethics and literature in the context of the historical and philosophical predicaments of contemporary society. The discussion is divided into two parts: the first is devoted to an exploration of contemporary ethical thinking, and the second on the contribution that literature can make to that thinking. In the first part, the author proposes an approach to ethics based on the virtue tradition which, since Aristotle, has defined ethics as the search for "the good life." This tradition, however, is transformed through an engagement with the work of Gilles Deleuze and Immanuel Levinas. From Deleuze the author draws the idea that the good life is one devoted to pursuing human plenitude through the multiplication of connections and intensities. From Levinas, on the other hand, emerges a powerfully haunting description of an ethical life marked by absolute responsibility for and obligation to the other. These two seemingly opposed views are not construed as irreconcilable and contradictory but rather as vectors which keep opposing tensions in check and ultimately define a necessary negotiation between the desire for human plenitude and the acknowledgement of responsibility for other human and non human life. Ultimately my argument is that such tensions establish the ethical terrain in which contemporary narratives seek to intervene. In the second part of the article, the nature and possibilities of such an intervention are explored through six theses which provocatively articulate the relationship between literature and ethics. The cornerstone thesis is that literature is an encounter. Each subsequent thesis endeavours to develop this initial assertion and explore its consequences. The theses are accompanied by a gloss which unfolds its meaning and significance: the answers that the given thesis provides but also the questions that it raises. Together, the theses provide a heuristic framework for a literary criticism sensitive to ethical issues and therefore capable of grappling with the important cultural work carried out in fictions that have struggled to receive the recognition they deserve. The car has become ubiquitous in late modern society and has become the leading object in the ordinary social relations of mobility. Despite its centrality to the culture and material form of modern societies, the relationship between the car and human beings has remained largely unexplored by sociology. This article argues that cars are combined with their drivers into an assemblage, the ‘driver-car’, which has become a form of social being that brings about distinctive social actions in modern society – (...) driving, transporting, parking, consuming, polluting, killing, communicating and so on. To understand the nature of this assemblage a number of theoretical perspectives that describe the interaction and collaboration between human beings and complex objects are explored; the process of driving, ‘affordance’, actor-network theory, and the embodied relationship between driver and car. This theoretical account of the driver-car is intended as a preliminary to the empirical investigation of the place of the driver-car in modern societies. (shrink)

Este trabajo analiza los aspectos más destacados de la polémica entre Juan Carlos Bayón y Eugenio Bulygin acerca de las lagunas jurídicas, el principio de prohibición y el alcance de la discreción judicial. En esta disputa, Bulygin defiende cuatro tesis centrales, enunciadas en Normative Systems : una cuidadosa distinción entre normas y proposiciones normativas es esencial para resolver el problema de las lagunas jurídicas, la versión débil del principio de prohibición no sirve para mostrar que no existen lagunas, la (...) versión fuerte del principio de prohibición es verdadera solo cuando el sistema es completo, y en casos de lagunas jurídicas, los jueces tienen discreción para resolver estas situaciones. Sin embargo, Bayón señala que el problema no es la falta de distinción entre normas y proposiciones normativas sino el desacuerdo acerca de cuándo una solución jurídica es concluyente. La diferencia entre soluciones prima facie y concluyente es esencial porque en ciertas situaciones, el derecho no da una respuesta pero tampoco deja espacio para la discrecionalidad judicial. Según Bayón, en estos casos el principio de prohibición "todo lo que no está prohibido está permitido" juega un papel fundamental. Este trabajo muestra que los argumentos de Bayón son insuficientes para rechazar las tesis clásicas defendidas por Bulygin. In this paper I analyze the most relevant aspects of the controversy between Juan Carlos Bayón and Eugenio Bulygin about the existence of legal gaps, the so called "principle of prohibition" and the scope of judicial discretion. In this debate, Bulygin defends four classical theses advanced in his wellknown book, Normative Systems : a careful distinction between norms and norm propositions is actually needed in order to solve the problem of legal gaps, the analytical truth of the weak version of the principle of prohibition cannot guarantee the completeness of legal systems, the strong version of the principle of prohibition is true only if legal systems are complete, and judges have discretion in cases of legal gaps. However, Bayón claims that the problem is not the lack of distinction between norms and norm proposition but rather the identification of conclusive legal solutions. Conclusive legal solutions must be distinguished from the prima facie solutions provided by explicitly enacted norms. According to Bayón, the difference between conclusive and prima facie solutions is essential in legally irrelevant cases; in such cases the principle of prohibition plays an essential role because it entails the rejection of judicial discretion. In this paper I claim that the arguments advanced by Bayón fail to provide a sound ground for discarding the classical theses defended by Bulygin. (shrink)

A filosofia ambiental surge na década de 1970 movida pelo ímpeto de reflexão sobre a iminência de uma crise ecológica e suas causas mais profundas. E a questão central que motivou os trabalhos pioneiros neste campo foi a crítica ao centramento humano em termos de valor moral, isto é, a assunção de que o _homo sapiens_ constitui o único _locus_ de valor frente às demais espécies e à natureza mais que humana como um todo. A demanda por uma nova ética, (...) de caráter ambiental, nasce precisamente do desafio ao antropocentrismo predominante na tradição filosófica ocidental, à luz das ideias de continuidade e interdependência do humano em relação ao mundo mais que humano, sugeridas pelos princípios da ciência ecológica. Tal proposta, entretanto, suscitou um interessante debate acerca da viabilidade e implicações de posturas senciocêntricas, biocêntricas e ecocêntricas, como forma de fundamentar o valor intrínseco para além da esfera da agência moral. A chamada _clivagem antropocêntrico-ecocêntrico _demarca precisamente os polos deste debate, que marcou os primeiros passos da filosofia ambiental e se estendeu à ecologia política. Apesar de algumas tentativas de retratar posturas não antropocêntricas como um dogma a ser superado na evolução da pesquisa em ética ambiental, este artigo procura argumentar que a questão permanece em aberto, sobretudo a partir de uma recente retomada das críticas ao antropocentrismo por um grupo de autoras e autores ligados às ciências ambientais. Some important ideas in Kelsen's Pure Theory of Law can be traced back to Kantian tradition, which has been very influential in Kelsen's thought, particularly in his early period. Among them we find the distinction between two radically different worlds (the world of facts and the world of norms), the normativity of legal science and the idea of validity as a binding force, based on the famous doctrine of the basic norm. These tenets and, especially, the use of a normative (...) concept of validity prove to be incompatible with Kelsen's positivistic programme of a value‐free legal science. The science of law cannot state that legal norms are obligatory or binding without trespassing the limits of Kelsen's ideal of a legal science; on the other hand, it is possible to define the concept of a legal system without resorting to the basic norm. So, if Kelsen is to be regarded as a consequent positivist, the Kantian ingredients of his theory must be rejected and the descriptive concept of validity as membership must be substituted for the normative notion of validity as a binding force. Carroll Izard’s theoretical and empirical work has played a preeminent role in energizing the renascence in the study of the emotions and emotional development in normality and pathology. A brief historical overview of his career is presented. Izard’s differential emotions theory (DET) has exerted influence in a number of domains and disciplines. Illustrations are provided from research and prevention in developmental psychology and developmental psychopathology. In the long history of the interpretations of Hume's theses on the self and personal identity, it is by now widely accepted that the conclusions reached in the first book of the Treatise must be considered in light of what the philosopher adds on these themes in the second and third books. Furthermore, there is no longer much support for the reading, which saw a contradiction here, given that while in the Book 1 he denies the reality of the self (...) or of personal identity, he then accepts that reality when he turns to his discussion of the passions. In presenting a more comprehensive reading of the theses of Hume on the self in the Treatise as a whole, it is essential not to lose sight of what Hume himself declared in Book 1, that "we must distinguish betwixt personal identity, as it regards our thought or imagination, and as it regards our passions or the concern we take in ourselves". But having recognized the necessity of integrating the theses on the self of Book 1 with those advanced in the latter two books, there are still divergent opinions on what meaning should be assigned to this integration. The relationship between what Hume writes on the self in Books 2 and 3 and the discussion of that topic in Book 1 has been seen, variously, as a mere continuation, as a new development in a continuous interpretation, or, rather, as a completely new posing of the question, with its own new solution. This article explores the link between religion and politics, religious liberty and the rights of religious minorities, by focusing on the constitutions which Italian states adopted and discarded from 1796 to 1849. It concerns questions about the ‘national character’ and the rights and duties of the citizen, and argues that – far from being ‘an outlet’ for material discontent – questions of religious identity and pluralism were integral to the Risorgimento definition of liberty. In this context, the author explores also (...) the Mazzinian vision of a democratic republic inspired by an acephalous and non-hierarchical civil religion, similar to the Unitarian Transcendentalism practiced by some of his New York admirers – a far cry from the ‘religions of politics’ inspired by Saint Simon and Auguste Comte.
